WHISTLEBLOWING COMMISSION MAKES RECOMMENDATIONS

The Whistleblowing Commission has published a report which makes 25 recommendations for improving protection for whistleblowers and encourages a culture of compliance with whistleblowing legislation. The report follows a survey on whistleblowing and research into whistleblowing in financial services. The Commission's recommendations include that the Secretary of State should issue a code of practice which should be taken into account by courts and tribunals when making decisions in whistleblowing cases. Attached to the report is the draft code of practice which the Commission recommends should be adopted, subject to consultation.

The Government issued its own call for evidence into whistleblowing in July 2013 it has also agreed to take account of the Commission's findings in addition to considering legislative change and, in particular, the possibility of adopting a statutory or non-statutory code of practice. Our London and New York corporate crime teams and our employment group recently came together to discuss these developments at a seminar at which Cathy James, Chief Executive of Public Concern at Work, explained the Commission's proposals. Please contact us if you are a client and would like a copy of the seminar notes, or would like to discuss these issues further.
